TERMS OF SERVICE

第1条(総則)
本規約は、株式会社Distance Asia(以下「当社」)が運営するオンラインストア「DISTANCE」(以下「本サービス」)の利用条件を定めるものです。
第2条(会員登録)
1. 会員登録の申請は、本人が正確な情報を入力して行うものとします。代理登録は認められません。
2. 以下に該当する場合、当社は登録を拒否することができます。
・過去に本規約に違反し、会員登録を抹消された場合
・申請内容に虚偽が含まれる場合
・その他、当社が不適切と判断した場合
第3条(パスワードの管理)
1. 会員番号及びパスワードは会員本人が責任をもって管理するものとします。
2. 第三者への譲渡・貸与・開示は禁止します。
3. 不正使用が判明した場合は、速やかに当社へご連絡ください。
4. 管理不十分・不正使用等により生じた損害について、当社は責任を負いません。
5. 会員番号又はパスワードを入力した本サービスの利用が行われた場合、これらの紛失若しくは漏洩につきお客様が事前に当社に連絡していた場合又は紛失または漏洩につき当社に帰責性がある場合を除き、当社はお客様による本サービスの利用があったものとみなします。
第4条(登録情報の変更・退会)
1. 登録情報に変更が生じた場合は、速やかに更新するものとします。変更がなされなかったことにより生じた損害について、当社は責任を負いません。
2. 退会を希望される場合は、当社所定の手続きにより退会手続きを行うものとします。
第5条(売買契約の成立)
1. ご注文後、当社から発送確認メールが到達した時点で売買契約が成立するものとします。
2. 以下の場合、当社はご注文をキャンセルできるものとします。
・商品が廃番・欠品となった場合
・申込情報に虚偽が認められた場合
・システム障害等による価格誤表示があった場合
・ボット・ツールによる申し込みと判明した場合
・数量制限を超えた申し込みがあった場合
・決済エラーが発生し決済が完了しない場合
・その他、当社が解約の必要があると判断した場合
第6条(支払)
ご利用いただける決済手段は特定商取引法のページに記載の通りです。支払時期は決済手段によって異なります。
第7条(返品)
返品の条件及び手順は、特定商取引法のページに記載の通りとします。
第8条(禁止事項)
以下の行為を禁止します。違反した場合、当社は売買契約の解約、会員資格の停止又は損害賠償請求等の措置を取ることができます。
・虚偽情報による申し込み又は購入
・ボット又は自動化ツールによる申し込み
・転売・商業目的での購入、及び海外転送を目的とした購入(当社の事前書面による承諾がある場合を除く)
・購入意思のない注文
・複数アカウントの不正取得
・本サービスの運営を妨害する行為
・当社又は第三者の著作権・商標権・知的財産権を侵害する行為
・当社又は第三者を誹謗中傷する行為
・公序良俗に反する行為・法令違反行為
・不正アクセス、システム改ざん又は有害プログラムの送信
・故意の受け取り拒否又は長期不在による返送(繰り返す場合、以降の注文をお断りする場合があります)
・その他、当社が不適切と判断する行為
第9条(抽選販売)
1. 応募後の辞退、サイズ・カラーの変更又はお届け先の変更はお受けできません。
2. 当選商品の自己都合による返品・交換はお受けできません。ただし、当選商品に瑕疵がある場合には第7条(返品)の定めに従います。
3. ご当選後、住所不備、長期不在等の理由により商品が当社に返送された場合、理由の如何にかかわらず当選をキャンセルとさせていただきます。
4. 複数アカウントを使用して応募された場合、以降の抽選を含め当選対象外とさせていただきます。
5. 過去に受取拒否又は長期不在による返送があったお客様は、当選を控えさせていただく場合があります。
6. 抽選結果に関するお問い合わせにはお答えできません。
7. その他、各抽選の応募ページに記載の注意事項に従うものとします。
第10条(反社会的勢力の排除)
1. お客様は、自らが暴力団、暴力団関係企業その他の反社会的勢力に該当しないことを確約するものとします。
2. 前項の違反が判明した場合、当社は事前通知なく会員登録抹消・注文キャンセル等の措置を取ることができます。
第11条(知的財産権)
本サービス上のすべてのコンテンツ(テキスト、画像、動画、ロゴ、デザイン等)の著作権、その他の知的財産権は、当社又は正当な権利者に帰属します。無断複製、転載、二次利用等は禁止します。
第12条(免責事項)
1. 天災、システム障害、配送業者の事故等、当社の責めに帰さない事由による遅延又は損害について、当社は責任を負いません。
2. 当社は本サービスのコンテンツの完全性又は正確性を保証するものではありません。
3. 外部リンク先の内容について、当社は責任を負いません。
4. 当社が責任を負う場合であっても、当社の故意又は重過失がない限り、責任の範囲は直接かつ通常の損害に限ります。
第13条(サービスの変更・停止)
当社は、その判断により、事前の通知なくサービスの全部又は一部を一時停止、変更、又は終了できるものとします。これには以下の場合が含まれますが、これらに限りません。
・システムの定期保守又は緊急保守
・不正アクセス又はコンピュータウイルス被害への対応
・天変地異、その他やむを得ない事情
第14条(個人情報の取り扱い)
お客様の個人情報は、別途定める「プライバシーポリシー」に従い取り扱います。
第15条(規約の変更)
当社は本規約を、必要に応じ、①利用者の一般の利益に適合する範囲、又は②本規約の目的に反せず合理的な範囲で、改訂できるものとします。本規約を改訂する場合、改訂後の本規約の内容及びその効力発生時期を、当社所定のサイトへの掲示その他適切な方法により周知するものとし、改定後の本規約は、当該効力発生時期が到来した時点で効力を生じるものとします。
第16条(準拠法・管轄裁判所)
本規約の準拠法は日本法とします。本規約に関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service
Article 1 (General Provisions)
These Terms of Service set forth the conditions for use of the online store "DISTANCE" (hereinafter "the Service") operated by Distance Asia Co., Ltd. (hereinafter "the Company"). By using the Service, customers are deemed to have agreed to these Terms.
Article 2 (Member Registration)
1. Applications for member registration must be submitted by the applicant themselves with accurate information. Registration by proxy is not permitted.
2. The Company may refuse registration in the following cases:
- The applicant has previously violated these Terms and had their membership revoked
- The application contains false information
- The Company otherwise determines the application to be inappropriate
Article 3 (Password Management)
1. Members are responsible for managing their member ID and password.
2. Transferring, lending, or disclosing passwords to third parties is prohibited.
3. In the event of unauthorized use, please contact us immediately.
4. The Company shall not be liable for any damage arising from inadequate management or unauthorized use.
5. If the Service is used by entering a member ID or password, the Company will deem such use to have been made by the customer, except in cases where the customer has notified the Company in advance of the loss or leakage of such credentials, or where the Company bears responsibility for such loss or leakage.
Article 4 (Changes to Registered Information / Withdrawal)
1. Members must promptly update their registered information if any changes occur. The Company shall not be liable for any damage resulting from failure to make such updates.
2. Members wishing to withdraw must follow the Company's designated withdrawal procedure.
Article 5 (Formation of Sales Contract)
1. A sales contract is formed when the shipping confirmation email sent by the Company reaches the customer after the order is placed.
2. The Company may cancel an order in the following cases:
- The product is discontinued or out of stock
- False information is found in the application
- A pricing error occurred due to a system malfunction
- The order is determined to have been placed using a bot or automated tool
- The order exceeds the quantity limit
- A payment error occurs and payment is not completed
- The Company otherwise determines that cancellation is necessary
Article 6 (Payment)
The available payment methods are as stated on the Specified Commercial Transactions Act page. The timing of payment varies depending on the payment method.
Article 7 (Returns)
The conditions and procedures for returns are as stated on the Specified Commercial Transactions Act page.
Article 8 (Prohibited Activities)
The following activities are prohibited. In the event of a violation, the Company may take measures including cancellation of the sales contract, suspension of membership, or a claim for damages.
- Submitting applications or making purchases using false information
- Submitting applications using bots or automated tools
- Purchasing for resale or commercial purposes, or purchasing for the purpose of international forwarding (except where prior written consent has been obtained from the Company)
- Placing orders without intent to purchase
- Improperly obtaining multiple accounts
- Interfering with the operation of the Service
- Infringing on the copyrights, trademarks, or intellectual property rights of the Company or third parties
- Defaming or slandering the Company or third parties
- Engaging in conduct contrary to public order and morals or in violation of laws and regulations
- Unauthorized access, system tampering, or transmitting harmful programs
- Intentionally refusing delivery or being absent for an extended period resulting in a return (if this occurs repeatedly, future orders may be declined)
- Any other conduct that the Company deems inappropriate
Article 9 (Lottery Sales)
1. Withdrawals, changes to size or color, or changes to the delivery address after entry are not accepted.
2. Returns or exchanges of winning products due to personal preference are not accepted. However, if the winning product has a defect, Article 7 (Returns) shall apply.
3. If a product is returned to the Company after winning due to reasons such as an incorrect address or extended absence, the winning entry will be cancelled regardless of the reason.
4. If a customer enters using multiple accounts, they will be disqualified from winning in that and future lotteries.
5. Customers who have previously refused delivery or had a product returned due to extended absence may be disqualified from winning.
6. Inquiries regarding lottery results will not be answered.
7. In all other matters, participants must follow the terms and conditions listed on each lottery entry page.
Article 10 (Exclusion of Antisocial Forces)
1. Customers represent and warrant that they do not belong to organized crime groups, companies affiliated with organized crime groups, or any other antisocial forces.
2. If a violation of the preceding paragraph is discovered, the Company may, without prior notice, revoke membership, cancel orders, or take other appropriate measures.
Article 11 (Intellectual Property Rights)
All copyrights and other intellectual property rights in content on the Service (including text, images, videos, logos, and designs) belong to the Company or the rightful rights holders. Unauthorized reproduction, republication, or secondary use is prohibited.
Article 12 (Disclaimer)
1. The Company shall not be liable for any delays or damages arising from causes beyond the Company's control, such as natural disasters, system failures, or accidents by delivery companies.
2. The Company does not guarantee the completeness or accuracy of the content of the Service.
3. The Company shall not be liable for the content of external linked sites.
4. Even in cases where the Company bears liability, unless there is willful misconduct or gross negligence on the part of the Company, the scope of liability shall be limited to direct and ordinary damages.
Article 13 (Changes to and Suspension of the Service)
The Company may, at its discretion, temporarily suspend, modify, or terminate all or part of the Service without prior notice. This includes, but is not limited to, the following cases:
- Scheduled or emergency system maintenance
- Response to unauthorized access or computer virus damage
- Natural disasters or other unavoidable circumstances
Article 14 (Handling of Personal Information)
Customers' personal information will be handled in accordance with the separately established "Privacy Policy."
Article 15 (Changes to Terms)
The Company may revise these Terms as necessary, within the scope of (1) being in the general interest of users, or (2) not contradicting the purpose of these Terms and being within a reasonable range. When revising these Terms, the Company will notify users of the content of the revised Terms and the effective date by posting on the Company's designated website or by other appropriate means, and the revised Terms shall take effect upon the arrival of the specified effective date.
Article 16 (Governing Law and Jurisdiction)
The governing law of these Terms shall be Japanese law. In the event of any dispute arising in connection with these Terms, the Tokyo District Court shall be the court of first instance with exclusive agreed jurisdiction.
